The various steps required to obtain a court judgment for possession of real property can be complex. It is always recommended to contact an attorney for help and legal advice. The following is the most basic process for an eviction:

  • Landlord’s notice to the tenant
  • Unlawful Detainer lawsuit in court
  • Sheriff’s eviction after obtaining a Writ of Possession

Landlord notices, such as a 3 Day Pay or Quit notice, 30 Day eviction notice, or 60 Day eviction notice, are not provided by the Sheriff’s Office. Sheriff personnel are also prohibited from assisting with these forms or recommending what manner of form to use.

After the Civil Division is provided with a Writ of Possession, instructions on Judicial Forms SER-001 and SER-001A, and the $180 service fee, the Civil Division will serve a five-day notice to vacate at the eviction property. The Civil Division will then schedule a date and time to meet the property owner or agent to restore back possession of the property. It is during this appointment that deputies will remove any occupants still on the property.
