Claiming Excess Proceeds
California Revenue & Taxation Code Section 4674 provides that any funds received for the sale of a tax defaulted property in excess of the taxes due and specific costs associated with the sale of the property may be claimed by parties of interest in the property sold. If you are a qualified party of interest in a property that has been sold at a Kings County tax sale, you may obtain a copy of the claim form by clicking here or by visiting the Kings County Tax Collector’s office during normal business hours.
Please note that in order to be considered, you MUST file:
- A completed Claim for Excess Proceeds form with notarized signature
- Documentation sufficient to support your claim. This documentation varies depending on your claim to the proceeds (lien holder, title holder, or other party of interest) and is listed in the instructions on the second page of the form.
- Please note that if you are filing as the title holder / owner of record, your claim MUST include a copy of the deed that granted your ownership interest in the property AND a copy of a valid government issued photo ID.
Any claims not postmarked within 12 months of the recordation of the tax sale deed cannot be considered.
